Is There a Time Limit on Boundary Disputes?

Boundary disagreements have a habit of simmering for years before anyone acts — which is exactly why one of the most common questions we hear is whether it is already too late to do anything. The short answer: there is no single “time limit on boundary disputes”, but time does change your options, and in some situations it can hand the disputed land to your neighbour permanently.

The 12-Year Rule: Adverse Possession

If a neighbour has occupied land beyond the true boundary openly, without permission and without challenge, they may eventually claim it. For unregistered land the classic period is 12 years. For registered land, a squatter can apply after 10 years — you will be notified and can object, but only if the Land Registry has your correct contact details. The longer encroachment goes unchallenged, the stronger the other side’s position becomes.

Fences, Hedges and ‘Acquiescence’

Even short of adverse possession, courts give weight to long-standing physical features. A fence that has stood unchallenged for fifteen years is persuasive evidence of where both parties believed the boundary lay — whatever an old conveyance plan suggests. Objecting early, in writing, protects your position even if you do not litigate.

What to Do If a Dispute Is Brewing

First, establish the facts before the positions harden: a boundary survey compares title plans, Ordnance Survey mapping and physical evidence on the ground, and often resolves the matter without lawyers. The Practical Time Limit
